1 – Definitions

Cookie: a set of data that can be transmitted to the User’s browser by the web site connected to by the latter. The web browser stores it for a certain period, depending on the nature of the Cookie, and returns it to the web server each time the User connects to it again. Cookies serve among other things to memorize an identifier that tracks the User’s browsing for statistical purposes.

Personal data: in accordance with Article 4 of the General Data Protection Regulation of 27 April 2016 (GDPR), Personal data is any information concerning an identified natural person or one that can be identified directly or indirectly by an identification number or particulars specific to the said person. To determine where a person is identifiable, one should consider all the means at the disposal of the data controller or anyone else for identifying the said person.

Intellectual property rights: all the Intellectual property rights, including but not limited to copyright, software rights, database rights, patent rights, invention rights, trademark rights, distinctive marks, design rights, semiconductor topography rights, trade secrets and know-how.

Hyperlink: an element added to the content of a web page that when clicked accesses other content either on the same site (internal) or a third-party site (external).

Site: YesWeHack’s online storefront at https://www.yeswehack.com enabling web users to discover the services offered by YesWeHack. As well as the blog at https://blog.yeswehack.com/, enabling web users to read articles written by YesWeHack raising awareness about and promoting online security and closely related events.

User: any web user (natural person) visiting the Site.

2 – Intellectual Property

All Rights Reserved, YesWeHack is a registered trademark of YesWeHack, the publisher of the Site. The Site (including all the accessible information, in particular the texts, photos, images, audio, data and databases) is protected by Intellectual property rights and/or other rights that YesWeHack holds or is authorized to use. The User has no Intellectual property rights to the Site or to its content. Any total or partial reproduction of this brand and logo for any reason whatsoever, in particular for advertising purposes, without the prior written consent of the trademark holder is prohibited on pain of legal action.

The user may on no account store, reproduce, represent, modify, transmit, publish or adapt any parts of the Site on any medium whatsoever, by any means whatsoever, or use them in any manner whatsoever, without the prior written consent of YesWeHack.

Each party is and remains owner, as far as they are concerned, of their distinctive marks, namely trademarks, company and other names, trade names, signs and domain names. Reproduction, imitation or partial or total affixing of trademarks and designs and models belonging to YesWeHack is strictly prohibited without its prior written consent.

3 – Site security

Users undertake to inform YesWeHack forthwith, by any means, of any error, offence or irregularity they notice in the use of the Site as soon as they learn of it.

Users undertake not to attempt to modify headers or manipulate pages of the Site so as to conceal, misappropriate or modify it. It is also prohibited to create any work or site deriving in full or in part from this Site, or to resell or redistribute YesWeHack’s data.

It is prohibited to:(i) use and/or access the Site for any purposes other than those permitted by these Terms and Conditions of Use; (ii) reproduce, modify, adapt or affect the Site and/or its Content; (iii) create derivative works; (iv) access or try to access the Site’s source code using decompiling or reverse engineering techniques or any other means whatsoever; (v) put restricted parts of the Site or Content at the disposal of third parties. Users undertake not to infringe any legal standard or use the Site for illegal purposes, or include any false, incomplete or inaccurate information, virus, Trojan Horse, worm, time bomb or any other program designed to cause damage, have a detrimental effect, intercept or counter any system, data or personal information.

4 – Non-commercial links

Hyperlinks to other web sites or sources of information offered on the Site are edited and/or managed by third parties in order to enhance the relevance of the User’s browsing experience. As the Site’s publisher cannot control the content of such external sources, the User recognizes that the publisher assumes no liability regarding the provision of such resources, their content, any collection and transmission of Personal data, installation of Cookies or any other processes intended for the same ends and carried out by the said sites.

Users recognize that Hyperlinks on the Site to another web site are neither a recommendation nor approval of the other web site or its content, unless the supplementary conditions of the service provided to registered Users so specify. It is up to Users to use such information with discernment and a critical mind.

5 – Protection of Personal data

The Personal data of the Site’s Users is collected and processed by YesWeHack in its capacity as controller. Such data is needed to administer the Site, produce site traffic statistics (anonymous) and manage its various forms. Data collected via the Site’s contact form is processed to respond to your enquiry. YesWeHack only sends its Newsletter or news of its events or requests for contact with a sales representative with the prior consent of the User (by means of tick boxes). Users’ rights to their Personal data: the right of access, the right to rectification or erasure of their data, the right to data portability, the right to withdraw their consent (opt out), the right to object to the processing thereof, the right to restriction of processing, the right to file a complaint with the CNIL (the French data protection authority), and the right to issue instructions in the event of death. 6 – Tracker Cookies

The Site uses cookies and third-party cookies placed by its partners for the purpose of analysing the browsing of visitors, to communicate relevant advertisements to them and also to provide social network sharing functions. 7 – Governing law – Dispute resolution

In the event of a dispute concerning the interpretation, formation, validity or performance of these Terms and Conditions of Use or the use of the Site, YesWeHack and its Users expressly recognize that only French law applies.

Failing out-of-court settlement of any dispute concerning the interpretation, formation, validity or performance of these Terms and Conditions of Use and barring an agreement or compromise settlement, YesWeHack and the Users assign jurisdiction expressly and exclusively to the courts under the jurisdiction of the Court of Appeal of Paris, notwithstanding multiple respondents or emergency proceedings or claims for third-party contributions or interim measures. If the User fails to fulfil its obligation to try and seek alternative dispute resolution, which is his or her responsibility, YesWeHack shall not be deemed liable in this respect.
